SEMINAR REPORT ATA TRAINING SYSTEM (TEMPORARY / TEMPORARY ADMISSION)
I-INTRODUCTION


Monday to Thursday 07 February 2011 1O, held in the lobby of the consular institution, the Chamber of Commerce and Industry Dakar (CCIAD), the Seminar Training System ATA (Temporary Admission / Temporary Admission) organized by the CCIAD in partnership with the Senegalese Customs and the World Federation of Chambers of Commerce (International Chamber of Commerce / ICC).
The Training Seminar was attended by trade associations, customs Senegalese experts (es) of the Chamber of Commerce and Industry of Paris / France, CCIAD, the guests of the Chamber of Commerce and Industry Cote d'Ivoire, businesses and societies, customs attaché of the Embassy of France in Senegal, the press and other organizations interested in the subject. The training was
place over a period of four (04) days and has been based on theoretical sequences and interactive sequences.
The general view of participants, training on the system ATA (ATA Carnet) was progressing satisfactorily. Babacar Ndiaye
, Consultant, was the expert representing the HOUSE OF CRAFTS - Workers Cooperative Buildings (COB) / Association for the Advancement of trades workers (APRAO) Dakar / Senegal.

OPENING CEREMONY The opening ceremony was marked by the Representative of the President CCIAD of and responsible for the ATA World Federation of Chambers of Commerce International (CCI - WCF).

I-2 WORK PROGRESS

The work was carried out through theoretical papers and interactive exchanges between the Presidium, the expert trainers and participants.
We recorded communications from

- Laurence Bottier-Heiderscheid, head of ATA Carnets, World Federation of Chambers of the International Chamber of Commerce of Paris / France (International Chambers of Commerce - ICC / World Chambers Federation - WCF) , made a presentation on the role and structures of the World Customs Organization (WCO), the International Chamber of Commerce (ICC) and World Chambers Federation (WCF) on "The ATA System: An instrument of international trade." The basic principle of the ATA system remains in first place "the free movement of goods across borders and territory in a temporary suspension of customs duties and taxes," and secondly "the goods covered by an international guarantee system . Convention ATA (Temporary Admission / Temporary Admission) was adopted in 1961. But in 1990 the Convention was adopted in Istanbul which combines in a single instrument all the Conventions on temporary admission. The Istanbul Convention is intended to replace the ATA Convention.

- Xavier Fetter Manager - ATA Service Chamber of Commerce and Industry of Paris / France (CCIP), made a general presentation on "The ATA Carnet system. Mr. Fetter, acting Head of French operations of ATA Carnets and Expert Trainer, has shown the benefits of ATA System for companies, Customs and Government, national economies and the Chambers of Commerce. In summary, he noted that the ATA Carnet allows exporters, business, etc.. realize their business operations effectively without having to become experts customs.

- Colonel Jean Baptiste Diouf Regional Director of Customs in Dakar Senegal and Mr. Aly Mboup General Secretary CCIAD brought much experience in the interactive discussion.

I-3 WHAT THE ATA CARNET?
1) The ATA Carnet is:
● An international customs document created to facilitate the temporary admission - free of duties and taxes, three types of goods including: commercial samples, professional equipment and goods for fairs and exhibitions.
● A Guarantee for international customs duties and taxes that are paid.
2) The ATA Carnet is an authentic "merchandise passport" and a "Passport to International Trade."
3) the ATA since 1963.
4) The ATA Carnet is currently in force in 68 countries.

I-4 CLOSING CEREMONY

The closing ceremony was chaired by Mr. Abdoulaye Diagne Technical Advisor / Department of Commerce v. Republic of Senegal.
II Final evaluation
After the explanation of the Presidium, the practical case studies of the trainer and participant interaction, we noted during the discussion the following points: The Annual Conference ●
treats ATA and certificates of origin;
● Prime Certificate of Origin was established in 1801;
● The ATA Carnet, an alternative solution with the times for the international trade community;
● The 04 pillars of ATA System: Facilitation, simplification, Security and Lower Costs; ● The
Mauritania and Burkina Faso are not required by the ATA Carnet member because of its reliability ;
● The ATA Carnet is a simple document, simplified and standardized customs procedures relating to the temporary admission of goods;
● ATA Carnet reduces language barriers, providing the exporter deposits of fees and charges and depositing deposit;
● The ATA Carnet is a better security system!
● The ATA Carnet is a modern control Competitiveness / Traceability;
● The ATA Carnet, economically, is a single customs document;
● Basic Principle of Alternative ATA Bond declarative
● The ATA Carnet can be composed of different types of travel: single round trip, in circular, star, etc. combined. ;
● The ATA Carnet allows for the use of the goods that refer to types Convention (Example of the territory of Switzerland for Art Basel in Switzerland);
● The basic ATA Carnet is sold at 25 € (Twenty five euros)
● The ATA Carnet is an added value.
III-FINDINGS AND COMMENT
Why I went to follow the ATA Training System to the detriment of the World Social Forum 2011 Dakar (World Social Forum 2011 in Dakar / Senegal)?
Because we have made a contribution as non-state actors (NSAs) for Sustainable Development and Economic Growth Sustained (DD / CES) Community Development Program of ECOWAS (PCD / ECOWAS) at the Awareness Workshop and Regional Census 1O December 2010 in Dakar / Senegal with the ECOWAS Commissioner in charge of macroeconomic policies.
Because we have issued as a Member of the Platform of Non-State Actors to track the Cotonou Agreement in Senegal, sustainable contributions at the Brainstorming Workshop Theme Group Trade, Regional Integration and Consumer Protection - Theme: "Promoting and protecting consumers through the business strategies of regional integration" - from 13 to 14 December 2010 in Dakar / Senegal with the Platform for NSA Senegal / PRECAPBG UNDP / EU.
- In France, there is no VAT (Value Added Tax) for export, the ATA Carnet is an international document, this is not a tax but a temporary suspension;
- The ATA Carnet is on paper but will be full electronic 2013où protocols (with the USA, Britain etc..) are underway;
- Timeliness and efficiency for all stakeholders and policymakers in international trade, the SD / CES, so far without having the need to become experts in customs. Involve the ATA system is a strategic choice. The strength of the ATA system lies in its organization and international network of chambers of commerce and other organizations;
- Sometimes if the manager can not complete the forms, Customs says it can go through intermediaries (with customs declarations Commissioners agreed, freight etc.).
- In case of disputes and litigation: there are also many national declarations in addition to deposits deposit abroad (there is no limit for deposits of bond, the rate varies from one country to another); lifting bail sometimes very hard and long to currency problems (IFRS ) administrative procedures; Sustainable Development (SD) and the New Clean Technologies for the Environment (NTPE) Public Health and Sustainable Climate Change (H5N1, H1N1, bisphenol A, whiteflies gaps, dengue, cyanide, formalin or formaldehyde etc...)
- Whenever there is an operation of customs declaration and cons operation in the slips for Proof of ATA law;

- Sometimes, as in the French legislation, there is a procedure for temporary liaison office (ie, back office) that Customs often allows an intermediary (an area and / or another);
- As part of an investigation customs delays can be suspensive (02, 03 or so years O6.). The ATA Carnet is valid for 365 days (1 year) but for the Senegalese national law in case of dispute and the operator must remain O6 months in Senegal and if the dispute continues, he must leave and return if the operator risk not to be in good standing according to his residence within the country;
- In Senegal, the advantage of this tool ATA is cheaper than the customs declaration (2% of the value of goods), c ' is unfortunate that Senegal has issued only 03 books in 2009 whereas in France the number of books issued is approximately 35,000 (in 2009). It is also important to note that the International Conventions on the law bonuses.
- But at the International Chamber of Commerce, there are studies underway for global databases for tracking and electronic tagging in partnership with the WCO and other relevant partners (insurers, UN, UNCTAD, WTO etc.).
- With the ATA system, the goods can be: loaned or leased or used for compensation;
- NB: Even for a computer, with my expert friends of the international civil society (World Civil Society) participating in international meetings, they must make an ATA Carnet. And if it's just a tourist with his computer he currently uses, they must submit only one bill in his name at the customs. The Istanbul Convention came legislate with all kits / Notebooks / Electronics (ICT) that were not covered by the agreement because these types of equipment did not exist at the time;
- Sometimes , mares can give birth in transit and customs instead of one (01) ends up with two (02). Then everything will depend on the scope given tax (that may even token amounts);
- In England Chambers of Commerce are private law while in France they are public law on the harmonization of tariffs;
- Security and Risk ATA: there is the amount paid to the insurer "PREMIUM CAUTINNEMENT" regarding the cost of the bond filed with foreign customs, but not in any way constitute a transport insurance. The licensee shall himself subscribe to an insurance policy from a company;
- For customer identification, the natural person or legal entity must produce a legal document justifying its existence legal (and legal). Because if paying the holder of the ATA Carnet at the issue must adopt procedures to the ITC and litigation in the event of the insured costs (the monetary aspect of law);
- Apply the duties and taxes rigorously and effectively, Customs will increasingly use sophisticated means ultra but the operator is a person who tries to survive here is not the World Social Forum (WSF was held in same time in Dakar), but we only show the ATA Carnet is a value-added sustainable
- The International Chamber of Commerce is already referred, is now the CCIAD related to the customs to convince regional chambers of commerce (Kaolack, Saint-Louis, Louga, Matam, etc..) coming in a dynamic network. It is necessarily a permanent and continuous training to actors (CCIAD in connection with the International Chamber of Commerce) towards professionalism;
- In my scorecard already filed with the problems presented include: the lack of stakeholder participation Non-State Actors (NSAs) and experts from civil society and financial development, deficiencies in discussions with certain issues (IFRS, Governance economic law on bioethics and organ trade flows and exchange with laboratories on the 3rd generation of sustainable public health etc.).
- According to Colonel Jean Baptiste Diouf of the Presidium, at the end of this seminar, the Office of Customs will release a note (Circular) for the management of ATA. Also that the gangway must be endorsed by the customs office at the border ie the catwalk should be discharged;
- Then there are the aspects of sustainable development (SD) with increasing food (wheat in Switzerland, uprisings in the Arab Maghreb, 01 billion people suffering undernourishment Chronic in 2010 etc.).
- The Singapore issues on trade and services and the development of international environmental law should be included in the agenda of upcoming events;
- The notion of individuals and natural persons in the perimeter Tax WAEMU / ECOWAS, in the extractive mining and oil, should be reconsidered in the context of Foreign Direct Investment (FDI).
